Does divorce always come with surprises?

Divorce can be the occasion for some unpleasant revelations. For example, a spouse may have assumed that there were no secrets regarding marital finances. However, when approaching divorce, a spouse may find that he or she needs to become a detective in order to properly inventory the assets of the marital estate.

Specifically, a spouse may need to do some investigation to learn online passwords to accounts, schedules of automatic payments, holdings in a securities portfolio, and the associated account numbers and investment advisors. 

An attorney that focuses on family law and divorce issues can provide insight into state law nuances and the ins-and-outs of the local judges. Although it may be impossible to predict how a judge will rule with 100 percent accuracy, an attorney who has studied a court’s past decisions might provide more strategic insight. In some cases, it may be in a couple’s mutual interest to resolve issues outside of court. Presenting a mutual proposal to a court certainly has a better chance of success than rolling the dice in contested litigation.
