Before the divorce is over, spouse may receive temporary support

Even the quickest, least contentious divorce cases in Ohio may take months to complete. If one spouse did not work outside the home during the marriage, there is a good chance that he or she will not have a reliable source of income the moment he or she or is living alone.

Add children to the mix, and the typical separation period before a divorce is finalized can get expensive. And until it is final, there is no division of property, or spousal or child support coming in.

Ohio law recognizes the financial stress that the time between initiating a divorce and the day the divorce is finalized can be. That is why family law judges are allowed to order forms of temporary support for spouses who request them.

Examples of the types of support the judge might order one spouse to pay to the other include:

  • Spousal support, also known as alimony
  • Child Support
  • Mortgage or car payments
  • Debts
  • Health insurance
  • Education costs
  • Utilities

A spouse usually will receive temporary support when he or she is not in a position to support him- or herself. There is no legal formula or guideline in Ohio. However, things judges usually look at when considering a temporary support request include the needs of the requesting spouse, and the ability of the other spouse to pay. Keep in mind the purpose of this support is not to “punish” the paying spouse, but to help the other spouse maintain a household until the divorce is over.
